Acceptance and contractual incorporation
These General Terms and Conditions regulate the services and/or products contained on the website of SUMMER OF MUSIC FESTIVAL CASTELLO AIE (hereinafter the Promoter), with VAT number: V72767072, located at Obispo Salinas, 71, 12003 Castellón de la Plana (CASTELLÓN).
The General Terms and Conditions are established without prejudice to the specific conditions that may apply to specific services and/or products included on the website. Therefore, since these General Terms and Conditions are announced in a visible place on the website, thus guaranteeing the User the effective possibility of knowing their existence and content, this implies their acceptance of all of them. Consequently, the User, under their responsibility, must carefully read all the conditions.
The specific conditions will apply to certain products and/or services offered to Users through the website, whose access and/or use are subject to them, which, depending on the case, replace, supplement, and/or modify the General Terms and Conditions.
If the User does not agree with the content of these General Terms and Conditions, they must therefore refrain from accessing the website and operating through it.
The Promoter reserves the right to modify these General Terms and Conditions, prior to their publication through the same means, and it is the responsibility of the User to read them properly each time they access and/or use them.
Ticket
The ticket purchased for a musical event will grant access to the agreed-upon venue according to the details listed on the purchase ticket. The entity reserves the right to put different tickets up for sale than those considered in these conditions, prior to their publication through the same means. The ticket cannot be returned or exchanged, except in the case of the total cancellation of the event or a modification of the date of the event.
The Promoter reserves the right to modify, suspend, or alter any of the activities and performances proposed in the lineup. If the cancellation is total, the Promoter will return the amount of the ticket under the conditions that will be published through the same means, with the exception of the distribution cost, since this is a service provided by the sales channels at the time of the sale of the ticket.
Under no circumstances will the amount of the tickets be refunded if the cancellation occurs once the festival has begun.
If the event is canceled as a result of Covid-19 or any of its variants, the promoter will offer the user the option to exchange their ticket for another ticket with a new date set by the promoter within a year from the date of publication of the cancellation or postponement of the event, or to refund the ticket price, which the user must request through the channels made available by the promoter (hola@somfestival.es) within fourteen calendar days of the publication of the cancellation or postponement of the event.
Users with disabilities that require special services must inform the Promoter by sending an email to the address: hola@somfestival.es.
Tickets can only be purchased through sales channels authorized by the Promoter, namely; www.somfestival.es and authorized ticket sellers, and the Promoter is not responsible for tickets that have not been purchased through these sales channels.
Any ticket that is altered, broken, or has signs of forgery implies the prohibition of access to the bearer to the musical venue, without prejudice to the exercise of civil and/or criminal actions that correspond. It is reported, in this regard, that electronic security controls are carried out at the entrance to the venue with fraudulent ticket detection reading technology.
The Promoter is not responsible for theft or loss of objects at the musical venue.
Admission
The Promoter reserves the right to admission. Access or stay in the music venue will be denied to Users who:
-Contravene the Promoter’s instructions (prohibition of access to restricted areas or areas intended for uses other than User recreation, etc.).
-Behave violently or hinder the normal development of the show.
-Are in possession of or trafficking drugs. Are in a state of high drunkenness or drug intoxication.
-Introduce, carry or use any kind of weapons or objects that could produce the same effects, such as sharp or cutting elements or objects that are considered dangerous for security.
-The entry of food and drink into the music venue is also not allowed.
-Engage in annoying, unhealthy, harmful, dangerous, or illegal activities. In any case, expulsion from the music venue implies non-refund of the ticket price.
-Minors need a signed authorization from their parents or legal representative. In the case of minors under 16 years of age, it will also be mandatory to be accompanied by one of the parents or the legal representative, proving such an extreme (ID, passport, Family Book) and delivering the authorization to access the music venue at the box office, being the parent or legal representative responsible for the minor’s actions. Inside the venue, the non-location of the minor’s parent or legal representative will result in their expulsion, and the Promoter will be exempt from their custody or care.
Intellectual Property and Image Rights
- All image and intellectual property rights arising from any celebration or artistic performance that takes place within any of the venues where SUMMER OF MUSIC FESTIVAL CASTELLO AIE works are reserved.
- Recording, capturing, or filming images and sounds is not allowed without express authorization sent by the Promoter.
- Anyone who enters the venue consents to their appearance in images captured by authorized media and sponsors of the event for possible promotional and marketing purposes, as well as on social networks. The transfer of images will not entail any consideration by the promoter.
Data Protection
In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the data provided on the website as well as the ticket purchase platform will be communicated to the Promoter for the management of the event and its clients, as well as the sending of commercial and promotional information about their events, services, and products. As an event attendee, the User understands and accepts that their data/image may be published by it in the SUMMER OF MUSIC FESTIVAL CASTELLO AIE media for the aforementioned purposes. By purchasing a ticket for any of the events held by SUMMER OF MUSIC FESTIVAL CASTELLO AIE, the User accepts that their data will be communicated to other participating companies for event management. Such consent implies authorization by the User to receive information about services and products offered through these collaborating companies that may be of interest. You can consult the participating companies on this website. You can exercise your ARSOPL rights (access, rectification, deletion, opposition, portability, limitation) with respect to your personal data by sending a written request and attaching a copy of your ID to the address Obispo Salinas, 71, 12003 Castellón de la Plana (CASTELLÓN) or via email at hola@somfestival.es; we have models available through which you can exercise your ARSOPL rights.
Legislation
These General Conditions have been drafted in accordance with Law 34/2002, on Information Society Services and Electronic Commerce, Law 7/1998, on General Contracting Conditions, Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary regional laws, and other applicable legal provisions.
